      Ballot Initative Passed in 2022 Election

      • Overview: Colorado voters have passed a ballot initiative to decriminalize psychedelic mushrooms for people 21 and older and to create state-regulated “healing centers” where participants can experience the drug under supervision.

        Colorado’s ballot initiative would allow those 21 and older to grow, possess and share the psychedelic substances but not sell them for personal use. It also would allow people who have been convicted of offenses involving the substances to have their criminal records sealed.

        Oregon’s initiative is expected to take effect at the beginning of next year (2024).

      Natural Medicine Healing Act (two separate initiatives filed to get on 2022 ballot)

      • Overview: The first initiative would legalize possession and cultivation of an array of entheogenic substances, as well as establish a regulatory model for psychedelics therapy. Would remove penalties for personal use and add protections stating that legal psychedelic activities could not be used against a person when it comes to parental rights, violating parole/probation, access to public benefits or medical care, etc. The second is similar but a somewhat dialed-back proposal that would initially legalize psilocybin and psilocin alone for personal adult use while also allowing for the sale and administration in a therapeutic setting.
      • Status: Waiting for state approval so they can begin signature collection to get the initiatives on the ballot.

      Initiative 301

      • Passed in 2018, went into effect in 2019
      • Law effectively decriminalizes use or possession of psilocybin by people 21 and older, making it the lowest enforcement priority for police and prosecutors
